Are you sure the XML decl shouldnt be a PI ? :)

Incidentally, when XML is viewed as a subset of SGML, the XML
declaration *is* a processing instruction. And if it weren't for
the need to be a subset of SGML, the syntax of the XML declaration
could have been completely different.
